Law requirements related to student involvement in the Individuals with Disabilities Education Improvement Act (IDEIA) of 2004.

Transition Services

  • The transition requirements in the Individuals with Disabilities Education Act (IDEA) Amendments of 2004 (PL 105-17) defines transition services are a coordinated set of activities for a student with a disability and are designed within a results-oriented process, which focus on improving academic and functional achievement and facilitating from school to post school activities, including post-secondary education, vocational education, integrated employment (including supported employment), continuing and adult education, adult services, independent living, or community participation. 34 C.F.R. §300.43. (a)(1).
  • Transition services are based on individual student’s needs, taking into consideration the student’s strengths, preferences, and interests. 34 C.F.R. §300.43. (a)(2).

Transition Services in Individualized Education Programs (IEP)

  • A student’s individualized education program (IEP) should include transition services at the age of 16 or younger if determined appropriate by the IEP Team. 34 C.F.R. §300.320. (b).
  • IEP must include appropriate measurable postsecondary goals based upon age appropriate transition assessments related to training, education, employment, and, where appropriate, independent living skills. 34 C.F.R. §300.320. (b)(1).
  • Transition services need to assist the student in reaching those goals. 34 C.F.R. §300.320. (b)(2).

IEP Team and Transition Services Participation

  • The IEP team for each student with disability includes whenever appropriate, the student with a disability. 34 C.F.R. §300.321. (a)(7).
  • The student with disability must be invited to participate in IEP meetings if a purpose of the meeting is to discuss postsecondary goals and transition services for the student. 34 C.F.R. §300.321. (b)(1).
  • If the student does not attend the IEP meeting, the public agency must take other steps to ensure that the student’s preferences and interests are considered. 34 C.F.R. §300.321. (b)(2).
